The prolonged conflict situation and the tsunami natural disaster in Aceh, resulted need for more progressive philosophical legal reasoning to answer existing needs. Formal rules that apply legally are not sufficient conditions explore justice. This is a juridical issue at Syar'iyah Court. There needs be findings midst of society all squeezed difficult. Among issues must answered how marriage status was determined during conflict, which generally recorded, plus number key witnesses who died disasters. challenge Meulaboh Court case itsbat by imposing witness known as Syahadah al-Istifadah or customary nomenclature called Testimonium de Auditu. article field research approach civil law laws, books, Islamic especially focused on fiqh discusses "Shahadah Al-Istifadhah". conclusion results state Judge consideration accepting testimony sake creating determination creates certainty, justice benefit parties, so desired benefits life can fulfilled.
